Terms and Conditions

All products and services provided by Cake Eclipse are subject to the following Terms and Conditions. By placing an order, the Customer agrees to be bound by these Terms and Conditions.

1. INGREDIENTS AND ALLERGIES

All cakes, fillings, and icings may contain, or come into contact with, common allergens, including but not limited to soy, wheat, dairy, eggs, and nuts. It is the Customer’s responsibility to inform Cake Eclipse of any allergy or intolerance issues before confirming the booking. Cake Eclipse will not be liable for any allergic reactions resulting from the consumption of our products. All products labelled as "special dietary" are not guaranteed to be allergen-free and are suitable only for intolerances, not severe allergies. Cake Eclipse advises that all cakes be consumed on the day of the event for optimal freshness and quality.

2. QUOTATIONS

All quotations are valid for 5 days from the date of issue. A quote does not guarantee availability. If the requested date becomes unavailable before booking confirmation, Cake Eclipse is not obligated to honour the original quote. Quotations are provided subject to availability and do not constitute a booking until confirmed with a deposit.

3. ORDERS

We recommend at least 30 days' notice for all orders. However, we will accommodate last-minute orders if availability allows. Orders based on photos from other cake designers will be interpreted as our artistic interpretation. Exact reproductions are not guaranteed.

4. DEPOSITS

A 50% non-refundable deposit is required within 5 days of invoice to secure your booking. If your order is placed within 14 days of the event, the deposit must be paid within 24 hours of invoice. In cases where the final product meets the agreed specifications but the Customer declines to accept it, the deposit will not be refunded. The Customer may either: Pay the remaining balance and collect the product, or leave the product with Cake Eclipse at no extra cost.

5. UNFORESEEN CIRCUMSTANCES / FORCE MAJEURE

If Cake Eclipse is unable to complete the order due to illness, accident, or other unforeseen circumstances, the Customer will receive a full refund of the deposit within 7 days. The deposit will be refunded via bank transfer only, and the Customer will need to provide these bank details to Cake Eclipse. Cake Eclipse is not liable for delays or cancellations caused by force majeure events, such as natural disasters, public emergencies, or supply chain disruptions.

6. PAYMENT TERMS

The remaining balance must be paid no later than 7 days before the pickup or delivery date. Payments via internet transfer must clear into our account before the product leaves the premises. If paying by cash, please provide exact change as Cake Eclipse does not keep cash on-site and cannot provide change.

7. DELIVERY AND COLLECTION

Delivery will be handled with the utmost care, and the product will be handed over in a satisfactory condition. Once the product has been delivered or collected, responsibility for the cake passes to the Customer. If the Customer is unavailable at the agreed delivery time, the cake will be returned to Cake Eclipse, and the Customer must arrange collection at Cake Eclipse's convenience. Customers must follow all storage and handling instructions provided by Cake Eclipse. We are not responsible for any damages or deterioration that occur after the cake has left our care.

8. THIRD-PARTY COLLECTION

If a third party is collecting the order, the third party will receive all relevant instructions. Once the product is collected, the same terms of liability apply as if the Customer had collected the product personally.

9. DAMAGE AND COMPLAINTS

The Customer must inspect the product at the time of pickup or delivery. Once the cake leaves the premises or is delivered, Cake Eclipse is not responsible for any damage. Complaints must be raised within 24 hours of receiving the product. Any visible defects must be reported immediately at the time of collection or delivery.

In the case of an emergency or error in your cake delivery, please contact us immediately so we can resolve the issue. If you are unhappy with your cake for any reason, you must call us on the day of your event to explain the situation.

  • If you seek a refund, the following applies: You must contact us on the same day of your event.

  • The cake must be returned as evidence that it will not be used for the event.

  • Without proof of dissatisfaction and return of the cake, no refund will be issued.

This policy ensures that complaints are handled fairly and discourages the rare misuse of refund requests ("If we complain, we’ll get a free cake"). Our goal is to exceed your expectations and meet all your cake requirements, so please do not hesitate to contact us with questions or concerns. Complaints raised beyond 24 hours after pickup or delivery will not be considered, and no refunds will be issued if the cake has been consumed or altered in any way.

10. POSTPONEMENTS AND CANCELLATIONS

If an event is postponed, the new date will be subject to availability. If the new date is unavailable, the deposit will not be refunded but may be applied to a future order at Cake Eclipse’s discretion. Cancellations: More than 1 month before the event: A refund will be provided, less the non-refundable deposit and the cost of any purchased supplies. Less than 7 days before the event: No refunds will be issued. Refunds, if applicable, will be processed via bank transfer within 30 days of the cancellation notice. The Customer must provide their bank details for the refund.

11. HIRED EQUIPMENT

All hired equipment requires a deposit, which will be refunded upon the timely and undamaged return of the equipment. Late returns may incur additional charges. If the equipment is damaged or not returned, the cost of repair or replacement will be deducted from the deposit.

12. PUBLICATION RIGHTS

Cake Eclipse reserves the right to use photographs of our products for promotional purposes. We will not post images until after the event unless otherwise agreed. We will not use any photographs provided by the Customer (e.g., photos from events or children’s parties) without obtaining prior permission.

13. GIFT VOUCHERS AND FLYERS

Vouchers must be presented at the time of booking and will be treated like cash. Expired vouchers will not be honoured. All vouchers must be surrendered upon redemption.

14. SERVING SIZE ESTIMATES

Serving sizes are based on standard (dessert) portions of 1" x 2" x 4" high. Specialty cakes, carved cakes, or custom designs may result in different serving portions. It is the Customer's responsibility to order according to their specific requirements.

15. LIMITATION OF LIABILITY

Cake Eclipse’s total liability for any claim shall not exceed the amount paid by the Customer for the product. Cake Eclipse shall not be held liable for any indirect or consequential losses, including but not limited to emotional distress, loss of event enjoyment, or dissatisfaction with the product’s appearance.

16. DISPUTES AND GOVERNING LAW

In the event of a dispute, Cake Eclipse will make every effort to resolve the issue amicably. These Terms and Conditions are governed by the laws of Victoria, Australia. Any legal proceedings will be conducted within this jurisdiction.

17. AMENDMENTS

Cake Eclipse reserves the right to amend these Terms and Conditions without prior notice. The most recent version will be available on our website or upon request.

By placing an order, the Customer acknowledges that they have read, understood, and agreed to these Terms and Conditions.
